CRTC suspends post-CloudWiFi proceeding deadlines

The CRTC has suspended the deadlines it set for BCE Inc. to file tariffs on access to its fibre wire inside buildings and for other carriers to file interventions in a related proceeding. In a June decision, the regulator granted CloudWifi Inc. competitor access to Bell’s service wires in multi-dwelling units. It asked Bell to file access rates within 30 days of the decision, and said it is of the “preliminary view” that all internet service providers and “potentially” all telecommunications service providers must also allow access to inside wires. It launched a separate proceeding on that matter, asking those carriers to submit why they shouldn’t allow access by Aug. 5. But in a July 17 letter, the regulator suspended both of those deadlines, citing “the issues raised, the need for sufficient process, and the associated timelines.” The letter was in response to a Part 1 application filed by Bell earlier this month challenging that decision, arguing that the regime governing copper access can’t simply be ported over to fibre because of technological differences. Bell had also asked for an interim stay of that decision, and in its letter this week, the CRTC set an expedited process to determine whether to grant it. The deadline for comments on the request for interim relief is now July 24. In an intervention filed Monday, Rogers Communications Inc. backed Bell’s request for a stay. Rogers said it agrees with Bell that the June rulings, “which are applied exclusively to Bell, result in the asymmetrical application of new rules related to access to fibre to only one carrier, which is discriminatory and prejudicial against Bell.” It said that “it would be reasonable for the Commission to have a full proceeding to address the timeframes and modalities of obtaining consent for the transfer and use of fibre IBW on an industry-wide basis before imposing any obligation on any one carrier to make its in-building fibre available to third parties.”
